Terms of Service — Combat Empire

These Terms of Service ("Terms") govern your access to and use of combatempire.com (the "Site") and any products or services purchased through it (collectively, the "Services"), operated by Combat Empire LLC ("Combat Empire," "we," "us," "our").

By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

 

 

1. Acceptance of Terms

By accessing the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, our [Privacy Policy], [Shipping Policy], and [Refund & Return Policy]. We may update these Terms at any time (see Section 15); continued use of the Site after changes are posted means you accept the revised Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on this Site. If you are a minor, a parent or legal guardian must place the order on your behalf and supervise use of any purchased combat sports equipment. By using the Site, you represent that all information you provide is accurate and that you have the legal capacity to enter into these Terms.

3. Product Information

We make every effort to describe our combat sports equipment (gloves, gis, protective gear, training equipment, apparel) accurately, including sizing, materials, and images. However:

  • Colors may vary slightly due to display/monitor settings.

  • Product specifications (weight, padding density, materials) are provided by manufacturers and may change between production batches.

  • Combat sports equipment carries inherent risk of injury even when used correctly. Products are intended for training and competitive use as designed; they are not a substitute for proper coaching, supervision, or protective judgment. Combat Empire is not liable for injuries resulting from misuse, improper fit, or use outside intended purpose.

We reserve the right to correct product errors, limit quantities, or discontinue any product at our discretion.

4. Pricing

All prices are listed in the currency displayed at checkout and are subject to change without notice. Prices do not include applicable customs duties, import taxes, or fees for international orders (see our Shipping Policy). We reserve the right to correct pricing errors on the Site, even after an order has been placed, and will notify you before processing if a correction affects your order.

5. Orders & Payments

  • Placing an order is an offer to purchase, which we may accept or decline at our discretion (e.g., suspected fraud, pricing errors, stock unavailability).

  • We accept payment via major credit cards and PayPal, processed securely through Shopify Payments and/or PayPal.

  • You agree to provide accurate, current billing and shipping information. You are responsible for promptly updating your account details.

  • We reserve the right to limit or cancel quantities purchased per person, household, or order, particularly where we suspect resale or distribution activity inconsistent with retail purchasing.

6. Shipping

Shipping timelines, rates, and carrier information are detailed in our Shipping Policy, which forms part of these Terms. Estimated delivery dates are not guaranteed and may be affected by customs, courier delays, or high order volume.

7. Returns, Refunds & Exchanges

Returns, refunds, exchanges, and cancellations are governed by our Refund & Return Policy, which forms part of these Terms. Custom and personalized items (e.g., name/logo customization) are final sale except in cases of defect or our error.

8. Intellectual Property

All content on this Site — including the Combat Empire name, logo, product designs, photography, graphics, and text — is the property of Combat Empire LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or use any of this content for commercial purposes without our express written permission.

9. User Conduct

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law;

  • Upload viruses, malware, or any code intended to disrupt the Site;

  • Attempt to gain unauthorized access to our systems, other users' accounts, or non-public areas of the Site;

  • Submit false, misleading, or fraudulent order or account information;

  • Harass, threaten, or post unlawful, defamatory, or obscene content (e.g., in product reviews);

  • Scrape, crawl, or harvest data from the Site without permission.

Violation of this section may result in immediate suspension or termination of your access to the Site (see Section 13).

10. User-Generated Content

If you submit reviews, photos, testimonials, or other content to the Site, you grant Combat Empire a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with marketing and operating the Site. You are solely responsible for the accuracy and legality of content you submit, and confirm it does not infringe any third party's rights.

11. Third-Party Links & Tools

The Site may contain links to third-party websites or integrate third-party tools (e.g., payment processors, shipping carriers). We do not control and are not responsible for the content, policies, or practices of third parties. Use of third-party services is at your own risk and subject to their own terms.

12. Warranty Disclaimer

Except as expressly stated in our Refund & Return Policy or required by applicable consumer protection law, the Site and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Nothing in this section limits any statutory warranty rights you may have under the consumer protection laws of your country of residence (e.g., EU/UK consumer rights, which cannot be waived by contract).

13. Limitation of Liability

To the fullest extent permitted by law, Combat Empire, its officers, employees, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages — including lost profits or data — arising from your use of the Site or products purchased through it. This includes, without limitation, injuries sustained during training or competitive use of purchased equipment, except where such injury results from a proven manufacturing defect covered under our Refund & Return Policy.

Our total liability for any claim arising from your use of the Site or a purchased product shall not exceed the amount you paid for the product giving rise to the claim.

This limitation does not apply to liability that cannot be excluded under applicable law (e.g., liability for death or personal injury caused by negligence, where such exclusion is unlawful).

14. Indemnification

You agree to indemnify and hold harmless Combat Empire, its officers, employees, and affiliates from any claim or demand — including reasonable legal fees — arising from your breach of these Terms, misuse of purchased equipment, or violation of any law or third-party right.

15. Account Suspension & Termination

We reserve the right to suspend or terminate your account or access to the Site, without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or misused the Site. You may stop using the Site or request account deletion at any time by contacting us.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

Before pursuing formal legal action, we encourage you to contact us at support@combatempire.com to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts located in Wyoming, United States, except where applicable consumer protection law grants you the right to bring a claim in your local jurisdiction.

17. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.

18. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy, constitute the entire agreement between you and Combat Empire regarding use of the Site, superseding any prior agreements.

19. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page with a new "Last updated" date. Continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
